If you’re subject to an HOA, you don’t have to worry because the law clearly states that home improvements that lead to producing renewable energy cannot be restricted. This is according to Colorado Revised Statute (CRS) 38-30-168 which states:

“A covenant, restriction, or condition, contained in any deed, contract, security instrument, or other instrument affecting the transfer or sale of, or any interest in, real property that effectively prohibits or restricts the installation or use of a renewable energy generation device is void and unenforceable.”

In basic terms? Your HOA can’t stop you from having solar panels installed on your home. Of course there are some restrictions, so be sure to consult a lawyer if you have any questions about this or need further advice.

Colorado Solar Rebates
